Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Stuti Systems mobile application and website (the "Service") operated by Stuti Systems ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Use of Service

1.1 Account Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

1.2 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. EV Rental Terms

2.1 Rental Agreement

When renting an electric vehicle from Stuti Systems, you agree to the specific terms outlined in the rental agreement, which may include:

  • Duration of rental (daily, weekly, or monthly)
  • Rental fees and security deposit requirements
  • Condition of the vehicle at the time of rental
  • Your responsibility for damages
  • Return procedures and late fees

2.2 Driver Requirements

To rent an electric vehicle, you must:

  • Be at least 18 years of age
  • Possess a valid driver's license
  • Provide valid identification (Aadhar card, PAN card, or passport)
  • Provide proof of address

2.3 Security Deposit

A security deposit is required for all rentals. The deposit amount will vary depending on the vehicle and rental duration. The deposit will be refunded upon return of the vehicle in the same condition as when rented, minus any applicable charges for damages, late returns, or other fees as outlined in the rental agreement.

2.4 Vehicle Usage

You agree to:

  • Use the vehicle only for lawful purposes
  • Not exceed the maximum range or capacity of the vehicle
  • Not modify or tamper with the vehicle in any way
  • Report any mechanical issues or damage immediately
  • Not use the vehicle while under the influence of alcohol or drugs
  • Follow all traffic laws and regulations

3. Service and Repair Terms

3.1 Service Agreements

When scheduling a service or repair with Stuti Systems, you agree to the terms outlined in the service agreement, which may include:

  • Service fees and payment terms
  • Timeframe for service completion
  • Warranty information for repairs

3.2 Parts and Warranty

All parts provided by Stuti Systems come with a manufacturer's warranty, details of which will be provided at the time of purchase or service. Warranty claims are subject to the specific terms and conditions of the manufacturer.

4. I-POWER Products Terms

4.1 Product Sales

When purchasing I-POWER products from Stuti Systems, you agree to the following terms:

  • Payment must be made in full before delivery or collection of products
  • Prices are subject to change without notice
  • Products are subject to availability

4.2 Product Warranties

I-POWER products come with specific warranties as stated on the product packaging or documentation. These warranties do not cover damage due to misuse, improper installation, or unauthorized repairs.

5. Payments and Refunds

5.1 Payment Methods

We accept payments through various methods including credit/debit cards, UPI, and cash for in-store transactions. Online payments are processed through secure third-party payment processors.

5.2 Refund Policy

Our refund policy varies by service type:

  • Rentals: No refunds for early returns unless specified in the rental agreement.
  • Products: Unopened and unused products may be returned within 7 days with proof of purchase for a full refund or exchange. Defective products are covered under their respective warranties.
  • Services: Service fees are non-refundable once the service has been performed.

6. Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Stuti Systems and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Stuti Systems.

7. Limitation Of Liability

In no event shall Stuti Systems, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of or inability to access or use the Service;
  2. Any conduct or content of any third party on the Service;
  3. Any content obtained from the Service; and
  4. Unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Indemnification

You agree to defend, indemnify and hold harmless Stuti Systems and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
